香港公民代表會議遞交反對《基本法》23條立法意見書

【2024年2月28日】香港公民代表會議（下稱本會）根據經二○二四年二月二十五日進行的第一次會議議決後，一致通過以下決議，反對香港特別行政區政府於二○二四年二月提出的《基本法》第二十三條立法草案（下稱草案）：

香港公民代表會議承接第六屆香港區議會（6th District Councils of Hong Kong）於二○二○年六月六日舉行的十七區區議會大會特別會議動議中，「反對任何形式收緊民主自由的法例，港區國安法摧毁一國兩制，將香港的未來推向萬劫不復的深淵，必須立即撤回」的精神，反對香港特別行政區政府於二○二四年二月提出的《基本法》第二十三條立法草案。

本會並通過將會把上述動議連同意見書，提交予香港特別行政區的同時，向公眾公布，以讓大眾了解《基本法》第二十三條立法的問題，並提高公眾警覺。

意見書總長約2800字，共分19段。包含反對草案定義模糊，「境外干預」、「間諜」、「國家秘密」、「煽惑」、「域外有效」、「非法操練」、「隱匿叛國」等條文的反對意見，以及草案明文禁止破壞社會主義制度等條文明顯違反《基本法》中訂明「一國兩制」的保障，及《公民權利和政治權利國際公約》中訂明所有民族有權自由決定其政治地位並自由從事其經濟、社會與文化之發展的條文內容。

藉本意見書的發布，本會為保障香港公民的福祉，與其他國際香港民主倡議者一同堅決反對香港特別行政區政府於二○二四年二月提出的《基本法》第二十三條立法草案，及所有以任何形式收緊香港公民民主自由的法例。

[February 28, 2024] Assembly of Citizens’ Representatives, Hong Kong (ACRHK) (hereinafter referred to as the Assembly), unanimously passed the following resolution in accordance with the decision made at the first meeting held on February 25, 2024, opposing the legislative proposal of Article 23 of the Basic Law of the Hong Kong Special Administrative Region (hereinafter referred to as the Proposal) submitted by the Hong Kong Special Administrative Region Government in February 2024:

The Assembly of Citizens’ Representatives, Hong Kong inherits the spirit of the motion passed at the Special Meeting of the 6th District Councils of Hong Kong held on June 6, 2020, which “opposes any legislation that tightens democratic freedoms, the destruction of the ‘One Country, Two Systems’ by the National Security Law, and pushes Hong Kong’s future into an irreversible abyss, and must be immediately withdrawn,” and opposes the legislative proposal of Article 23 of the Basic Law submitted by the Hong Kong Special Administrative Region Government in February 2024.

The Assembly also passed the motion to submit the above motion together with the submission to the Hong Kong Special Administrative Region for public disclosure, to enable the public to understand the issues related to the legislation of Article 23 of the Basic Law and to raise public awareness.

The opinion letter is approximately 2,800 words long, divided into 19 paragraphs. It includes opposition to the vague definition of the Proposal, as well as opposition to articles such as “foreign interference,” “espionage,” “state secrets,” “incitement,” “effective overseas,” “illegal exercise,” and “concealing treason,” and the obvious violation of the safeguards of “One Country, Two Systems” stipulated in the Basic Law and the provisions of the International Covenant on Civil and Political Rights, which stipulate that all peoples have the right to freely determine their political status and freely engage in their economic, social, and cultural development.

Through the publication of this opinion letter, the Assembly, along with other international Hong Kong democracy advocates, firmly opposes the legislative proposal of Article 23 of the Basic Law submitted by the Hong Kong Special Administrative Region Government in February 2024, and all legislation that tightens democratic freedoms for Hong Kong citizens in any form, to safeguard the welfare of Hong Kong citizens.
